Terms of Service

1. Acceptance of Terms

By booking any service with Exploriah Travel Company ("Exploriah," "we," "us," or "our"), you agree to be bound by these Terms of Service. These terms apply to all adventures, tours, and services provided by Exploriah.

2. Booking and Payment

Reservation Requirements

• All bookings require advance reservation
• Full payment or deposit required to confirm booking
• Valid government-issued ID required for all participants
• Medical disclosure form must be completed

Pricing and Fees

• All prices are in Canadian Dollars (CAD)
• Prices include GST/HST where applicable
• Additional fees may apply for special requests
• Group discounts available for 6+ participants

3. Cancellation and Refund Policy

Client Cancellations

• 48+ hours notice: Full refund minus processing fees
• 24-48 hours notice: 50% refund
• Less than 24 hours: No refund
• Multi-day expeditions: 7 days notice required for full refund

Weather-Related Cancellations

• Tours cancelled due to unsafe weather conditions will be rescheduled at no charge
• If rescheduling is not possible, full refund will be provided
• Weather decisions are made by Exploriah guides for safety reasons

4. Health and Safety Requirements

Participant Responsibilities

• Must be physically capable of participating in chosen activity
• Must disclose all relevant medical conditions
• Must follow all safety instructions and guidelines
• Must not participate under influence of alcohol or drugs

Age Requirements

• Minimum age varies by activity (specified in service descriptions)
• Minors must be accompanied by parent/guardian
• Special arrangements required for unaccompanied minors

5. Assumption of Risk and Liability

Participant Acknowledgment

By participating in Exploriah activities, you acknowledge that:

• You understand the risks involved
• You participate voluntarily and at your own risk
• You release Exploriah from liability for ordinary negligence
• You agree to follow all safety instructions

6. Equipment and Personal Property

Provided Equipment

• Safety equipment provided and must be used as instructed
• Participants responsible for any damage beyond normal wear
• Lost equipment charges will be applied to participant's account

Personal Property

• Exploriah not responsible for loss or damage to personal items
• Secure storage not guaranteed in wilderness settings
• Travel insurance recommended for valuable items

7. Photography and Media

By participating in our tours, you consent to:

• Photography and video recording during activities
• Use of your likeness in Exploriah marketing materials
• Sharing of photos on social media and website

Please notify guides if you prefer not to be photographed.

8. Behavior and Conduct

Exploriah reserves the right to remove participants who:

• Endanger themselves or others
• Fail to follow guide instructions
• Display disruptive or inappropriate behavior
• Damage equipment or environment

No refund will be provided for removal due to misconduct.

9. Force Majeure

Exploriah is not liable for delays or cancellations due to events beyond our control, including:

• Natural disasters
• Government restrictions
• Transportation strikes
• Pandemic-related closures

10. Modifications to Services

Exploriah reserves the right to:

• Modify itineraries for safety or operational reasons
• Substitute comparable activities when necessary
• Change guides due to availability
• Update pricing with 30 days notice

11. Dispute Resolution

Complaints Process

1. Inform guide immediately of any concerns during tour
2. Contact Exploriah within 48 hours of tour completion
3. Submit written complaint within 7 days
4. Allow 14 days for investigation and response

Governing Law

These terms are governed by the laws of Manitoba, Canada. Any disputes will be resolved in Manitoba courts.

12. Changes to Terms

Exploriah may update these terms at any time. Continued use of our services constitutes acceptance of updated terms. Major changes will be communicated via email.
